Woman's Divorce-By-YouTube Is 'Scary New Step'

A New York woman involved in a divorce battle spilled secrets about her husband, his family and their intimate life in a "scary, new step" in user generated content, attorneys said.

Tricia Walsh-Smith can be watched on YouTube lashing out at her husband, Broadway executive Philip Smith, in a teary and furious clip that has been viewed more than 150,000 times.

Local 6 reported that lawyers can't think of another case like Smith's and are calling it a "scary, new step." During the video, Walsh-Smith goes through their wedding album on camera, accuses her husband of trying to evict her out of their apartment, and even makes embarrassing claims about their intimate life. Her lawyer said she acted out of passion and is a "victim who is holding her head up," though he wasn't representing her when she made the video.

Her husband's lawyers say they're "kind of appalled."

Other divorce experts said the video will likely come back to haunt her. They said the clip probably won't help her in front of a judge.

'Piracy': Why the Cure's Robert Smith doesn't get it

In what some have called a stubborn refusal to recognise that business models must adapt with the times, Robert Smith of the Cure has repeated a common refrain--one we are well used to hearing from the likes of the RIAA, among others--that we must "think of the artist". Responding to online criticisms of an earlier blog post he made, Smith has let it be know that he thinks that "IT SEEMS A FEW PROFESSIONAL APOLOGISTS (YOU HAVE TO LOVE THEM!) OUT THERE DISAGREE WITH MY 'EVERY ARTIST SHOULD VALUE THEIR ART' MUSING AND THINK ITS OK FOR ART - MUSIC IN PARTICULAR - TO BE MADE AVAILABLE FREE FOR ALL...".

Who's editing your CSS?

Anna Ullrich: The vast majority of front end web developers that I've met prefer to write their own markup in the code editor rather than let the program generate the markup for them. In fact, it's a point of pride to hand code because WYSIWYG programs have gotten a reputation for bloated code, mangled tags, and undesirable formatting. Of course this was never the case with Expression Web (for reals!) but once you've been burned by any markup generator, it's hard to trust any program with your code.

So when does Expression Web touch your CSS and how can you take control of it (or avoid it all together)? Come, let me show you the ways...

Viacom Kills Clip For Copyright Infringement (Though They Were the Infringing Ones)

Hard to believe but apparently true. YouTube pulled a clip from their site at the request of Viacom. So far, nothing unusual. But this clip, which filmmaker Chris Knight uploaded, was actually taken from the Viacom show Web Junk 2.0 depicting... a clip produced by Chris Knight, which Viacom used without his permission .

Chris says, Thats chutzpah. And YouTube simply complies with these takedown requests, ignoring their users fair use rights, though they did offer Chris to send a counter-notice (which Chris did, and is still waiting to hear back the clip in the meantime is already taken down).

Domain name '.eu' open for business

BRUSSELS, Belgium (AP) -- The European Union planted its flag in cyberspace Wednesday when the ".eu" Internet domain name opened for business.

Until now, Europeans had to choose between a national domain such as ".fr" for France or a global one like ".com," which is often seen as American.

EU Information Society Commissioner Viviane Reding said she expected several hundred thousand sign-ups for ".eu" in the first few days. National registries in some countries -- such as Belgium, home to the EU headquarters in Brussels -- are offering promotions to persuade Internet users to stay local.

But do Europeans want a ".eu" domain name? Some business groups are uncertain how popular it will be. Europeans have an EU flag, an EU passport and an EU anthem but many have a lukewarm attitude to European integration -- as French and Dutch "no" votes to a new constitution showed this year...

Can bloggers be journalists? Federal court says yes

When Philip Smith took to his blog to describe his (negative) experience of working with an eBay listing company, he did not expect that he would end up representing himself in a federal defamation and trademark dilution lawsuit or that he would have difficulty selling his condo after a lawyer for the plaintiffs clouded his title to the property. Now, after winning the case in spectacular fashion, Smith has emerged as an unlikely hero for bloggers everywhere who hope to be regarded as journalists.

No US court has yet weighed in with authority on the debate about whether bloggers count as journalists, but the recent federal decision from South Carolina does indicate that at least some bloggers are journalists. It's not about the title, it's about the content, said Judge Henry Hurlong, Jr.; a journalist turns out to be anyone who does journalism, and bloggers who do so have the same rights and privileges under federal law as the "real" journalists.

The case began when Smith blogged about his experience working with an eBay listing company called BidZirk. He had a less than satisfactory experience working with the company, and he used his article as a chance to talk about eBay listing services in general, then closed with a checklist that potential users of such services should consider.

Cray supercomputer designer to join Microsoft

Burton Smith, a longtime supercomputer designer and chief scientist at Cray, has resigned to take a position at Microsoft.

Smith was a founder of Tera Computer, which in 2000 acquired Cray Research from Silicon Graphics. The company, which was based in Seattle, was renamed Cray.

A Microsoft spokesman said Friday that Smith would work for Craig Mundie, one of Microsoft's chief technology officers and formerly chief executive of Alliant Computer Systems, a maker of an early mini-supercomputer.

Microsoft announced two weeks ago that it planned to introduce a new version of its Windows software for scientific and engineering users, and that Smith would be involved.

"He's a really smart guy and an innovator," said Steven Wallach, a founder of the Convex Computer Corporation, and currently a venture investor. "The designs he developed were milestones in computer architecture."..

No Windows 7 upgrade option in the EU

Today Microsoft announced the pricing of Windows 7. As previously reported on Neowin, the EU will be getting a version that will not contain IE and because of this Microsoft will be offering no upgrade option in the EU. This harsh line comes as somewhat as a surprise that all EU users that wish to upgrade to Windows 7 must buy a full copy. There is a silver lining to this announcement and it's that the full price of Windows 7 will be at the equaliviant price to the upgrade option.
